Delivery Terms and Conditions

 

Please read these Terms and Conditions carefully before using our website liftnship.com and making your online purchase and/or using the services of Ezo's Lift and Ship Corporation.

Your access to and use of this Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access our website or call for use this service.

By accessing or using this service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the service.  Customers must familiarize themselves with these Terms before placing an online order.

Terms Used in the Delivery Terms

Shipper - Customer using our services

Contractor - Carrier or person providing shipment and delivery of items

Home Delivery - Delivery of items from retail stores or (purchase from person-to-person) to your home residence 

Courier Service - Delivery of items to businesses

Indemnification - Compensation for harm or loss

Consequential Damages - Damages that can be proven, and/or foreseen, to have occurred because of the failure of one party’s

ability to meet a contractual obligation

1. General 

These Terms for Courier Service and Home Delivery Service establish the overall procedure for the provision of services of Ezo’s Lift and Ship Corporation, a brokerage company, terms for delivery of shipments, requirements for preparation of shipments and ordering services, conditions and procedure for collection, shipping and delivery of shipments, and restrictions of services provided when delivering within the counties of Hillsborough, Pasco, Pinellas and Hernando and procedure for examination of complaints and claims and indemnification of damages.

1.1 Service

Shipments made are shipped by surface transport and/or handled by a Ezo’s Lift and Ship Corporation independent contractor.  Our Services does not include nor does it provide "MOVING SERVICES" as we are not licensed as a moving company.

2. Delivery and Delivery Restrictions

Ezo’s Lift and Ship Corporation a brokerage company, that offers delivery services of general commodities, as usually defined, but are subject to the following restrictions:

2.1 Consumer-to-Consumer Delivery

Ezo's Lift and Ship Corporation, in sole and absolute discretion of its (contractors), may not accept or may refuse to provide service

in respect to any package or article: if MOVING SERVICES is suspected.  Our company is not licensed as a moving company, and any such request will result in package or article NOT being shipped and/or delivered to the designated location.
 

2.2 Weight and size 

Ezo’s Lift and Ship Corporation, in sole and absolute discretion of its (contractors), may not accept or may refuse to provide service in respect to any package or article: weighing more than 150lbs; or exceeding 88 inches in length, 60 inches in height or exceeding 100 inches in length and girth combined. Length is the longest side of the package or object. Girth is the distance all the way around the package or object at its widest point perpendicular to length. Irregularly shaped packages or objects are to be treated as if they were in a rectangular box for the purpose of measuring. Additional charges, including an Oversized Shipment surcharge and a Two Person Handling surcharge may apply to any such package tendered for transportation and/or delivery.

2.3 Limitations of Liability

It is agreed that for claims purposes (including a claim based upon failure to deliver, misdelivery, damage, loss or theft of packages), Ezo’s Lift and Ship Corporation’s liability is limited to a maximum of $50 per shipment regardless of the circumstances, including but not limited to, the gross negligence or negligence of Ezo’s Lift and Ship Corporation and its (contractors).

2.4 Limitations of Liability (Consequential Damages)

Ezo’s Lift and Ship Corporation shall not be liable for any special, incidental or consequential damages (collectively, the “Consequential Damages”) including, but not limited to loss of profit incurred by the shipper or any other person or company as the result of Ezo’s Lift and Ship Corporation’s (contractors) acts or omissions, including gross negligence or negligence causing damages, failure to deliver, mis-delivery, loss or theft of shipment, or late or delayed shipment. In any such event, Ezo’s Lift and Ship Corporation’s liability shall be limited to a refund of the shipping charges (pursuant to the terms of Ezo’s Lift and Ship Corporation’s shipping guarantee in effect at the time of shipment, if the shipment has been guaranteed by Ezo’s Lift and Ship Corporation to arrive on time).  This limitation of liability applies to all shipments.  In no event shall Ezo’s Lift and Ship Corporation be liable for Consequential Damages even if advised in advance of the possibility of such damages.

2.5 Prohibited and/or Restricted Items

No service shall be rendered in the transportation system of any of the prohibited/restricted items listed below:

  1.  Illegal Drugs 

  2. Weapons, firearms, or ammunition of any kind

  3. Human remains of any kind

  4. Live stock or living animals 

  5. Thermal sensitive goods 

  6. Dangerous goods (explosives, easily ignitable, poisonous) 

  7. Medication

  8. Perishable goods/items

  9. Hazardous materials (radioactive, waste materials, chemical substances)

  10. Currency, money orders and/or cashier’s checks

  11. Tobacco products

  12. Articles of high value (jewelry, bank cards, lottery tickets, gemstones)

In the event that any such prohibited articles enters Ezo’s Lift and Ship Corporation’s transportation system, this does not constitute a waiver on the part of Ezo’s Lift and Ship Corporation, nor shall Ezo’s Lift and Ship Corporation and its (contractors) have any liability whatsoever for delay, loss or damage to any such article.

2.5 Prohibited by Law

No service shall be rendered by Ezo’s Lift and Ship Corporation in the transportation of any shipment which is prohibited by law or regulations of any federal, state, or local government.

3. Refusal of Shipments 

Ezo’s Lift and Ship Corporation reserves the right to refuse any package in 'reasonable' judgement of our (contractors) that is dangerous in nature, economically or operationally impracticable to transport, or that is improperly packaged, wrapped or labeled. Ezo's Lift and Ship Corporation also reserves the right to refuse any delivery in 'reasonable' judgement of our (contractors) if that delivery is in suspicion of being a "MOVE" (as per clause 1.1).

4. Order Placement 

Orders for picking up of shipment will be accepted on Ezo’s Lift and Ship Corporation’s working days during our specified business hours.  Also orders for picking up, shipping, and delivery of shipments will be accepted only from shippers who pay Ezo’s Lift and Ship Corporation at the time of service. Ordering can be done online via our website or by phone. Information is listed below:

4.1 Additional Handling (Two Person Handling) Fee

Where applicable, (as per clause 2.1), an ‘Additional Handling’ fee, in effect at the time of shipping, may be added to the shipping charge and is at the sole discretion of the (contractors) for Ezo’s Lift and Ship Corporation.  Ezo’s Lift and Ship Corporation also reserves the right to assess for Additional Handling fee for any package that, in sole discretion of its (contractors), requires special handling or Two persons. Additional Handling fee may or may not be charged in combination with Oversized shipment fee (see clause 4.2 below).

4.2 Oversized Shipment Fee

A package is considered an ‘Oversized package’ (as per clause 2.1).  Where applicable, an additional charge may be applied to such packages tendered for transport and/or delivery. Also an Additional Handling (Two Person Handling) fee may also be applied to such tendered packages.

4.3 Redirect (Address Correction) Fee

If Ezo’s Lift and Ship Corporation is unable to deliver any shipment because of an incomplete or incorrect address; Ezo’s Lift and Ship Corporation will make reasonable efforts in locating the correct address. If the correct address is located, the shipper will be notified of the correction.  An additional fee, set forth by Ezo’s Lift and Ship Corporation applicable to the shipment in effect at the time of shipping, will be assessed to the shipment of service.

 

4.4 Stairs Fee

A surcharge will be applied for any delivery in which stairs are required for the deliverer/carrier to complete that delivery. 

 

5 Financial Transactions

Any and all Financial Transactions (including Additional Fees) must conducted through our website or by calling our office at

1-855-543-8744.  Ezo's Lift and Ship Corporation will not be held liable whatsoever for any such transactions outside of the pricing of our company and/or website for delivery services.

5.1 Payment of Additional Fees

Where applicable, some fees may be in 'reasonable' judgement of Ezo’s Lift and Ship Corporation (contractors). Additional fees, that are incurred as a result of an action by the shipper or failure by the shipper to provide proper detailed description of items being tendered for transport and delivery, the shipper will be asked to go online to our website liftnship.com/pricing-quote or call to have proper fees added in effect at time of shipping.  Failure by the shipper to pay proper fees will result in a delay or failure of items to be delivered without a refund.

6. Procedure for Refunds

The request for a refund should be submitted by contacting Ezo’s Lift and Ship Corporation via email or by phone. The information is listed below:

6.1 Full Refund

In the event that the shipper, for any reason, would like a refund, after placing an order and payment has been made and processed by Ezo’s Lift and Ship Corporation and it is before the (contractor) has arrived for pickup, a full refund shall be given to the shipper. Provided the shipper has made a proper refund request.

 

6.2 Partial Refund

In the event that the shipper, for any reason, would like a refund, after placing an order and payment has been made and processed by Ezo’s Lift and Ship Corporation and it is after the (contractor) has arrived for pickup, only a partial refund shall be given to the shipper. Provided the shipper has made a proper refund request. The refund given will be less $25.00 (to cover the cost of the contractor coming out to the shipper.)

 

7. Invoicing 

Ezo’s Lift and Ship Corporation provides invoicing via a link texted to the mobile phone number provided or a link emailed to the email provided.  The shipper pays all shipping charges including any additional charges in full upon receipt of invoice.  Failure to comply with paying the invoice may result in shipment and all its articles being returned and/or a delay in shipment at the time of shipping. Invoice orders are only made via telephone 1-855-LIFT-SHIP (543-8744).  In the event that a delivery is delivered to its designated location and the invoice has not been paid, Ezo’s Lift and Ship Corporation reserves the right to implement any legal rights and remedies available to it to obtain payment.
 

7.1  Business-to-Business Invoicing

A minimum 50% non-refundable deposit is required for all Business-to-Business deliveries. The remainder of the invoice order for shipping and delivery of shipments will be required to be paid upon arrival to the designated location.  Shipments addressed to a legal entity or business may require a signature upon receipt, to an administrative employee of the same company.  The shipper may request that their portion, remaining balance, or entire amount of the shipping charges be invoiced to an alternative party or the receiving party.  Failure to comply with 50% non-refundable invoicing deposit may result in shipment and all its articles being returned to the shipper and/or a delay in shipment at the time of shipping.  In the event the remaining balance of the invoice is not paid by the corresponding party as agreed upon, Ezo’s Lift and Ship Corporation reserves the right to implement any legal rights and remedies available to it to obtain payment.

 

7.2  Business-to-Customer/Customer-to-Customer Invoicing

Upon receiving confirmed payment of invoice (as per clause 7), shipments addressed to an individual at his/her workplace, educational institution, dormitory, military service, hospital, sanatorium, camp or place of imprisonment etc. shall be delivered to the administration or persons authorized by them.

 

8. Waiting Time Fee (Courier Services)

A ‘Waiting Time’ Charge may be applied when a contractor or agent of Ezo’s Lift and Ship Corporation has to wait for either a pick up or delivery shipment.

 

9. Proper Packaging and Labeling (Courier Services)

Shippers must package their shipments in a manner that properly protects the contents during transportation.  Every package tendered to Ezo’s Lift and Ship Corporation must contain complete “From” and “To” details including postal code or zip code, contact names, and telephone numbers. An additional Redirect fee may be applied for any package incorrectly labeled (as per clause 4.3).

 

10. Taxes

All applicable state and county taxes required by law will be charged on all costs and surcharges.  The customer agrees to pay Ezo’s Lift and Ship Corporation any and all taxes assessed.

 

11. All figures in United States Dollars (USD)

All figures referred to in these Terms and Conditions are in United States dollars (USD).

 

12. Procedure for Claims and Complaints

A claim may be filed by the shipper when Ezo’s Lift and Ship Corporation and its (agents or contractors) does not meet its on-time delivery commitment, or for loss of a shipment, and/or dissatisfaction with the service provided.  All claims/complaints must be submitted by:

All claims notifications must include shipment details, including address (from/to), date of shipment, package weight (if known), and a detailed statement of what is being claimed or complaint. Upon receipt of a “reasonable” claim submitted in accordance with the established procedure Ezo’s Lift and Ship Corporation shall indemnify the damages no later than 72 hours from receipt of claim/complaint
 

13. Force Majeure

In no event, shall Ezo’s Lift and Ship Corporation be responsible for any delay of delivery, prevention of delivery, stoppage of delivery, damage to customer property or loss of customer property due to “Force Majeure.”  Force Majeure shall include conditions beyond the control of both the customer and the (contractors) of Ezo’s Lift and Ship Corporation. Such conditions include acts of God, acts of terrorism, law or order of any government, war, acts of war, civil commotion, epidemic, riots, failure or default of public utilities, destruction of facilities by a earthquake or hurricane like catastrophe.  In the event of Force Majeure, the customer shall be given ONLY a partial refund of half the processed payment, regardless if pickup and delivery is completed or not.  

 

14. Links To Other Websites

Our website liftnship.com may contain links to third-party web sites or services that are not owned or controlled by Ezo’s Lift and Ship Corporation. Ezo’s Lift and Ship Corporation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Ezo’s Lift and Ship Corporation shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

15. Changes

Ezo’s Lift and Ship Corporation reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is made we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a change will be determined at our sole discretion.
